Can I help my mother or father with this?

Yes. Many of our calls come from a son or a daughter, and you can join most of each meeting. Your parent is our client. So we talk with your parent alone for part of the first meeting.

Your part

  • Book the meetings and drive
  • Gather and upload documents
  • Sit in on most of each meeting
  • Get copies once your parent agrees

Your parent's part

  • Talks with us alone for part of the first meeting
  • Tells us in their own words what they want
  • Understands and signs each document

Someone has died. What do I do first?

You do not need to do it all this week. These five things matter in the first two weeks. They are in the order most families do them.

  1. Ask the funeral home for 10 certified death certificates.Banks and insurers each keep one.
  2. Find the original will. A copy will not do.In Kansas, file it with the court within six months of the death, or it cannot be used.
  3. Leave their accounts alone for now.Moving money early can cause trouble later, even with the best intentions.
  4. Keep paying the house insurance and utilities. An empty house needs to stay insured.
  5. Collect the mail and list the bills. Then call us before answering any letter from a creditor.

You can also do all of this by phone, with a person. If your family lives in other states, these save a trip to Wichita.

Questions about wills, Medicaid and probate

We answer these on the phone most weeks. If your question is not here, call us.

Is the first meeting really free?

Yes. It lasts 45 minutes, at our office, your home or by phone. You leave with a flat price in writing and no obligation to go ahead.

Do we need a trust, or is a will enough?

For most Kansas families with one home, a will plan and a transfer-on-death deed keep the house out of probate. A trust helps when you own property in another state, have a blended family, or want money held for someone.

Mom has dementia. Can she still sign a power of attorney?

Often yes, in the early stages, if she understands what she is signing on the day. We meet with her alone for part of the visit. If she can no longer decide, the path is a guardianship, which we handle.

Will Medicaid take the house?

Not while a spouse or a dependent child lives there. KanCare can claim against an estate later, and planning ahead, ideally five years before care, is how you protect it. We explain the rules at the first meeting.

How long does probate take in Kansas?

Simplified probate usually takes four to six months. Full probate takes six to twelve. Creditors have four months from the newspaper notice to make a claim, so nothing can close sooner.

Can my brother and I both be involved?

Yes, with your parent's agreement. We can meet everyone together, keep you both copied, and name you jointly or one after the other in the documents.

Where is the office, and can I park there?

Yes. We are on East Central, a few blocks west of Rock Road. The office is on one level, with no stairs and parking at the door.
